MINISTERIAL DIRECTIONS UNDER SECTION 5(6)(a) and 5(7) OF THE REGULATORY AUTHORITY ACT 2011

For the avoidance of doubt, this Direction supersedes GN0551/2023 issued on June 23rd, 2023. In accordance with Section 7 of the Regulatory Authority Act 2011 and in exercise of my powers under Section 8 of the Electricity Act 2016 (EA 2016), I hereby direct the Regulatory Authority to promote the use of cleaner energy sources and technologies, and to protect the interests of end-users, pursuant to the provisions of Sections 6(c) and (e) respectively of the EA 2016. For ease of reference, Section 6(c) and (e) state:
The purposes of this Act include the following, namely, to seek—
(c) to promote the use of cleaner energy sources and technologies, including alternative energy sources and renewable energy sources:
(e) to protect the interests of end-users with respect to prices and affordability, and the adequacy, reliability and quality of electricity service;
Furthermore, I remind the Regulatory Authority of its duties under section 12 of the Regulatory Authority Act 2011 that states:
The principal functions of the Authority, in relation to any regulated industry sector, are—
(b) to promote the interests of the residents and consumers of Bermuda;
To clarify and in closing, these purposes and functions should be held paramount in all matters at all times by the Authority.
