Order made in accordance with the Civil Aviation (Air Transport Licensing) Act 2007
Specification of flights in respect of which the operator is not required to hold an air transport licence.

The Minister responsible for transport, in exercise of the powers conferred by section 8(3)(a) of the Civil Aviation (Air Transport Licensing) Act 2007, as amended by the Civil Aviation (Air Transport Licensing) Amendment Act 2024 (collectively referred to as “the Act”) hereby makes this order in accordance with section 8(3)(a) of the Act (“Order”), for flights of the following description:
Wet lease flights

For the purposes of this Order “wet lease flight” means a flight operated pursuant to a lease under the terms of which:

the lessor provides the aircraft and crew (including cabin crew unless otherwise agreed) and arranges for the maintenance and insurance of the aircraft and performs the flight operating under its own air operator’s certificate; and

the lessee markets and sells the capacity of the aircraft for the carriage of passengers and/or cargo and/or mail under contracts of carriage in the lessee’s own name using the lessee’s own flight designator, and is responsible for paying all the direct operating costs and other costs of the flight;
and a copy of the said wet lease has been provided to the Bermuda Civil Aviation Authority prior to the flight.

Nothing in this Order permits any flight that is not in accordance with the lessor’s air operator’s certificate.

This Order shall come into effect when published in the Official Gazette and remain valid until such time as the Minister determines.
